1. Collection, use and conservation of Personal Data object of treatment 

1.1 Personal Data subject to processing 

We obtain Personal Data about Clients when they choose to provide it for the purpose of providing a required service. Your Personal Data is only used for the provision of the required services, not used for other purposes, unless we obtain your consent, or unless required or permitted by applicable law and/or regulations in accordance with the principles and in terms of the provisions of the Federal Law on Protection of Personal Data Held by Private Parties and its regulations, hereinafter the LFPDPPP.

 

When information and Personal Data are provided to “Grupo Coinesaser” and/or JAVIER ROSAS BOBADILLA , we will use this information in the manner indicated in this instrument. Your Personal Data will not be used for other purposes, unless we obtain your permission, or unless the LFPDPPP or other applicable regulations require or allow it.

 

The Personal Data that we may collect are the following:

 

a) Identification and contact information: full name, email and CURP;

b) Labor data: Name of the company for which you provide your services, position or position you hold.

c) Financial and/or patrimonial data: Proof of income and proof of payment of worker-employer obligations.

 

The processing of your personal data and labor data for the purposes established in this privacy notice does not require your prior consent as it is covered by the grounds of exception contained in article 10 section I of the LFPDPPP, due to the fact that The processing of your personal data is required by law, in particular, by those laws that have been reformed in terms of subcontracting by decree dated April 23, 2021 published in the Official Gazette of the Federation, among which include the Federal Labor Law, Social Security Law, Law of the Workers’ Housing Fund Institute, Income Tax Law, Value Added Tax Law and Federal Fiscal Code.

 

1.2 Ways of collecting Personal Data 

 

The Personal Data subject to treatment will be collected in the following ways:

a) Personally, by delivering or sending your Personal Data directly to our offices or by sending it through electronic means.

b) Indirectly, by delivering or sending Personal Data through an authorized third party or your employer.

 

1.3 The legal grounds we have for using your Personal Data 

 

“Grupo Coinesaser” and/or JAVIER ROSAS BOBADILLA collects only the Personal Data necessary to fulfill your request for services, keeping its due confidentiality. If it is necessary to have additional and optional information, you will be notified at the time of your request, for your collection and protection in terms of this instrument.

 

The LFPDPPP in Mexico allows us to process Personal Data, as long as we have a legal purpose to do so. we process your Personal Data, we rely on one of the following processing conditions:

 

a) Execution of a contract: When the processing of your Personal Data is necessary to fulfill our obligations under a contract.

provide information to a public body or law enforcement agency.

c) Legitimate interest: Offer information about our services and carry out marketing activities.

1.4 Retention of your Personal Data 

In accordance with the principle of proportionality in the processing of your Personal Data, we inform you that your personal data will be kept and used by “Grupo Coinesaser” I JAVIER ROSAS BOBADILLA solely and exclusively for as long as it is necessary to fulfill the purposes for which your treatment was submitted, as well as in accordance with the conservation periods provided for by applicable legislation.

Once the previously established conservation periods have expired, your personal data will be securely deleted from the database where they are stored.

 

2. Transfer of Personal Data 

“Grupo Coinesaser” and/or JAVIER ROSAS BOBADILLA will not transfer your Personal Data to any national or international company under any circumstances, since these will only be used internally for the fulfillment of the purposes previously set forth.

3. EXERCISE OF ARCO RIGHTS 

You have the right to know what personal data we have about you, what we use them for and the conditions of use that we give them (Access). Likewise, it is your right to request the correction of your personal information in case it is outdated, inaccurate or incomplete (Rectification); that we eliminate it from our records or databases when it considers that it is not being used in accordance with the principles, duties and obligations set forth in the regulations (Cancellation); as well as oppose the use of your personal data for specific purposes (Opposition). These rights are known as ARCO rights.

b) Copy of official identification.

c) In case of being exercised by a legal representative: Copy of the holder’s identification, identification of the Representative and Instrument with which he proves personality.

d) ARCO right that you wish to exercise.

e) Personal data on which you wish to exercise your ARCO rights.

f) In the event that your application does not have the information established in the preceding paragraphs, it will be considered as not submitted.

g) Requests for ARCO Rights will be processed and resolved within the terms established for this purpose in article 32 of the Federal Law on Protection of Personal Data Held by Private Parties, therefore, once your request is received, we will notify you of the resolution. to it within a period not exceeding 20 business days, which will become effective within a subsequent period of 15 business days.
